What happens if a breath sample is failed?

 
 

This is state dependent and varies if you are on probation or parole. In Wisconsin if you’re not on either of those and only have the DMV and local sheriffs office as your monitoring agencies then failed tests after the vehicle is started counts as a violation. Failed tests before the vehicle is started don’t count towards them unless over four one after the other are failed in short succession.

When a test counts as a violation you can enter a violation reset mode requiring forced early service. Which does such by engaging a Violations will get reported to your monitoring agencies. Monitoring agencies have the discretion to impose penalties.
